 1. PURSUANT TO SECTION 94-35(I) OF THE ZONING AND LAND
 DEVELOPMENT REGULATIONS (ZLDRS), FAILURE TO COMPLETE
 AND MAINTAIN ALL APPROVED ELEMENTS OF AN APPROVED SITE
 PLAN, INCLUDING LANDSCAPE, APPEARANCE, AND OTHER SITE
 DEVELOPMENT FEATURES, SHALL BE A VIOLATION SUBJECT TO
 ENFORCEMENT AND PENALTY PROCEDURES. SITE VISITS
 COMPLETED ON OCTOBER 6, 2008 AND JANUARY 13, 2009,
 SHOWED THE FOLLOWING VIOLATIONS:
  
 A. THE LANDSCAPE INSTALLED ON THE SUBJECT PROPERTY DOES
 NOT MATCH THE LANDSCAPE PLAN APPROVED BY THE ZONING
 BOARD OF APPEALS ON SEPTEMBER 5, 1999. THERE ARE 2
 OPTIONS 1) INSTALL LANDSCAPING TO MATCH THE APPROVED
 LANDSCAPE PLAN; OR 2) PREPARE AND SUBMIT A NEW
 LANDSCAPE PLAN MEETING THE REQUIREMENTS AS STATED IN
 THE MEETING ON-SITE ON JANUARY 13, 2009. THE NEW
 LANDSCAPE PLAN SHALL BE PREPARED BY A LANDSCAPE
 ARCHITECT AND SUBMITTED AND APPROVED AS A REVISION TO
 THIS BUILDING PERMIT. NOTE: ALL MISSING LANDSCAPING
 (I.E. HEDGES, GROUND COVER, ETC.) SHALL BE
 INSTALLED/REPLACED PER ONE OF THE APPROVED PLANS.
  
 B. PURSUANT TO SECTION 94-446(2), LANDSCAPING SHALL BE
 MAINTAINED IN GOOD CONDITION, SHALL PRESENT A HEALTHY,
 NEAT, AND ORDERLY APPEARANCE, AND SHALL BE FREE FROM
 REFUSE AND DEBRIS. TREES ON THE SUBJECT PROPERTY SHALL
 BE CORRECTIVELY TRIMMED BY A CERTIFIED ARBORIST TO
 PRESENT A GOOD AND HEALTHY CONDITION. THE 2 POOR
 CONDITION LIVE OAK TREES ON THE NORTH PROPERTY LINE
 SHALL BE REMOVED. THE SEA GRAPE TREES THAT HAVE STARTED
 TO GROW ALONG THE WEST PROPERTY LINE SHALL BE REMOVED.
  
 C. THE SITE PLAN APPROVED BY THE ZONING BOARD OF
 APPEALS ON SEPTEMBER 5, 1999, SHOWED A TOTAL OF 10
 REQUIRED AND PROVIDED PARKING SPACES. HOWEVER, UPON
 REVIEW OF THE SITE, THE CONVENIENCE STORE ONLY REQUIRES
 8 PARKING SPACES AND THE CAR WASH THAT WAS ADDED LATER
 REQUIRES 3 PARKING SPACES. THERE ARE CURRENTLY ONLY 7
 PARKING SPACES ON THE SITE. WHILE THERE IS NO ROOM TO
 PROVIDE THE 4 ADDITIONAL PARKING SPACES ON SITE, THERE
 ARE ON-STREET PARKING OPPORTUNITIES ADJACENT TO THE

 FOR DETAILS ABOUT THE OFF-STREET PARKING.
  
 D. PURSUANT TO SECTION 94-444(B), ALL MECHANICAL
 EQUIPMENTS SHALL BE SCREENED BY WALLS AND FENCES. THE
 GENERATOR ON THE SOUTH SIDE OF THE BUILDING MAY NOT BE
 STORED ON THE LANDSCAPE. WHETHER STORED OR PERMANENTLY
 SITED, THE GENERATOR SHALL BE ON A CONCRETE PAD THAT IS
 PROPERLY SCREENED.
  
 E. AS DISCUSSED ON-SITE ON JANUARY 13, 2009, THE ICE
 MACHINE SHALL BE MOVED TO A SCREENED AREA OR REMOVED
 AND THE SIGNAGE SHALL BE REMOVED FROM THE WINDOWS.
  
 F. THE SIGN FOUNDATIONS AT THE NORTHWEST CORNER OF THE
 SITE SHALL BE REMOVED.
  
 2. VIOLATIONS LISTED IN COMMENT NO. 1 ABOVE SHALL BE
 ADDRESSED PRIOR TO OBTAINING A CERTIFICATE OF
 COMPLETION/OCCUPANCY FOR THIS PERMIT.
