 ***FAILED***
  
 1. A UNITY OF TITLE SHALL BE RECORDED FOR THE TWO (2)
 PARCELS (PCNS 74-43-44-10-03-000-0590 AND
 74-43-44-10-04-000-0010). PLEASE CONTACT VINCE NOEL,
 CITY SURVEYOR, AT (561) 494-1040 TO OBTAIN A COPY OF
 THE UNITY OF TITLE FORM AND ALL OTHER REQUIREMENTS. A
 COPY OF THE RECORDED UNITY OF TITLE SHALL BE PROVIDED
 WITH THIS BUILDING PERMIT APPLICATION.
  
 2. SUBMIT 2 COPIES OF A SIGNED AND SEALED SURVEY OF THE
 ENTIRE SITE. SURVEY SHALL BE LESS THAN A YEAR OLD.
  
 3. PURSUANT TO SECTION 94-36(I) OF THE ZONING AND LAND
 DEVELOPMENT REGULATIONS (ZLDRS), FAILURE TO COMPLETE
 AND MAINTAIN ALL APPROVED ELEMENTS OF AN APPROVED SITE
 PLAN, INCLUDING LANDSCAPE, APPEARANCE, AND OTHER SITE
 DEVELOPMENT FEATURES, SHALL BE A VIOLATION OF THIS
 CHAPTER SUBJECT TO ENFORCEMENT AND PENALTY PROCEDURES
 OF THIS ZONING CODE. A SITE VISIT COMPLETED ON OCTOBER
 6, 2008, SHOWED THE FOLLOWING VIOLATIONS:
  
 A. THE LANDSCAPE INSTALLED ON THE SUBJECT PROPERTY DOES
 NOT MATCH THE LANDSCAPE PLAN APPROVED BY THE ZONING
 BOARD OF APPEALS ON SEPTEMBER 5, 1999. PLEASE NOTE THAT
 IF AN UPDATED LANDSCAPE PLAN WAS APPROVED FOR THIS SITE
 SUBSEQUENT TO SEPTEMBER 7, 1999, A COPY SHALL BE
 SUBMITTED WITH THIS BUILDING PERMIT APPLICATION.
 OTHERWISE, LANDSCAPING ON SITE SHALL MATCH THE APPROVED
 LANDSCAPE PLAN, OR A NEW LANDSCAPE PLAN SHALL BE
 REVIEWED AND APPROVED BY THE PLANNING AND ZONING
 DEPARTMENT. ALL MISSING LANDSCAPING (I.E. HEDGES,
 GROUND COVER, ETC.) SHALL BE REPLACED.
  
 B. PURSUANT TO SECTION 94-446(2), LANDSCAPING SHALL BE
 MAINTAINED IN GOOD CONDITION, SHALL PRESENT A HEALTHY,
 NEAT, AND ORDERLY APPEARANCE, AND SHALL BE FREE FROM
 REFUSE AND DEBRIS. TREES ON THE SUBJECT PROPERTY SHALL
 BE CORRECTIVELY TRIMMED BY A CERTIFIED ARBORIST TO
 PRESENT A GOOD AND HEALTHY CONDITION.
  
 C. THE SITE PLAN APPROVED BY THE ZONING BOARD OF
 APPEALS ON SEPTEMBER 5, 1999 SHOWED A TOTAL OF 10
 REQUIRED AND PROVIDED PARKING SPACES. HOWEVER, THE
 SUBJECT PROPERTY ONLY HAS 7 PARKING SPACES. THE 3
 PARKING SPACES THAT WERE REMOVED ARE UNDER THE TENT.
 THE REQUIRED 10 PARKING SPACES SHALL BE MAINTAINED ON
 SITE.
  
 D. PER THE FINAL ORDER DATED SEPTEMBER 5, 1999, ?THE
 EXTERIOR PAY PHONE ALONG SOUTH DIXIE HIGHWAY SHALL BE
 REMOVED; NO FUTURE OUTDOOR PAY PHONES SHALL BE
 INSTALLED.? THERE IS A NEW PAY PHONE LOCATED ALONG
 HUNTER STREET, WHICH WAS NEVER SHOWN ON THE APPROVED
 SITE PLAN. THEREFORE, THIS PAY PHONE AND ANY OTHER
 EXTERIOR PAY PHONES ON THE SITE SHALL BE REMOVED.
  
 E. PURSUANT TO SECTION 94-444(B), ALL MECHANICAL
 EQUIPMENTS SHALL BE SCREENED BY WALLS AND FENCES. THE
 MECHANICAL EQUIPMENT LOCATED ON THE SOUTHEAST CORNER OF
 THE SITE SHALL BE SCREENED WITH A WALL AND A HEDGE AS
 REQUIRED PER THIS SECTION.
  
 4. VIOLATIONS LISTED IN COMMENT NO. 3 ABOVE SHALL BE
 ADDRESSED PRIOR TO OBTAINING A CERTIFICATE OF
 COMPLETION/OCCUPANCY FOR THIS PERMIT.
