 APPLICATION.
  
 THE CONSTRUCTION BOARD OF ADJUSTMENT AND
 APPEALS AT A SPECIAL HEARING ON 1/8/03,
 IN THEIR CASE # 1224, GRANTED A
 VARIANCE TO THE REQUIREMENT OF SECTION
 1014.1.1 OF THE 2001 FBC, THAT AT LEAST
 50% OF THE LONG SIDE OF THE BALCONY BE
 OPEN.
  
 A CONDITION IN THE ORDER GRANTING THE
 VARIANCE IS THAT THE BALCONY/STAIR AREA
 BE FIRE SPRINKLER PROTECTED.SECTION
 903.2 OF THE FBC REQUIRES IN PART,
 "AUTOMATIC SYSTEMS INSTALLED IN LIEU
 OF,OR AS AN ALTERNATE TO OTHER
 REQUIREMENTS, AS PERMITTED BY THIS
 CODE, SHALL BE CONSIDERED REQUIRED
 SYSTEMS AND SHALL COMPLYWITH NFPA 13.
  
 THE FIRE SPRINKLER DESIGN BY WAYNE
 AUTOMATIC FIRE SPRINKLER SYSTEMS, IS AN
 NFPA 13R SYSTEM AND DOES NOT COMPLY FOR
 THE "BREEZE WAY" AREA.
  
 FBC 1006.2.2 REQUIRES IN PART, THAT
 "ALLPORTIONS OF THE STAIRWAYS ON EACH
 LEVEL BE 1/2 THE DIAGONAL DISTANCE
 APART OF THE AREA SERVED".THE PLANS
 DO NOT COMPLY.
  
 AS PROVIDED FOR IN FBC 101.4.1,
 THE DESIGNER IS ADVISED THAT ABOVE IS A
 "SPECIFIC" REQUIREMENT AND TAKES
 PRECEDENCE OVER "GENERAL" REQUIREMENTS.
 TO THAT END, THE EXCEPTION IN FBC
 1004.1 IS NOT APPLICABLE.
  
 AS NOTED IN THE PREVIOUS REVIEW, IMPACT
 FEES MUST BE PAID, A RESIDENT INSPECTOR
 WILL BE REQUIRED, SPECIAL DISPENSATION
 FOR THE SHUTTERS IN LIEU OF IMPACT
 RESISTANT GLAZING AND A PROPERTY SURVEY
 WHENEVER THE PERMITS ARE APPLIED FOR.
