WE WALKED THE PROPERTY AND SHE WAS ADAMANT IN SAYING CAN THE FINES STOP ACCRUING DUE TO THE FACT THAT HER TENANTS WILL BE MOVED OUT SOON, AGAIN I EXPLAINED THERE WERE OTHER ISSUES THAT NEED TO BE ADDRESSED AS WELL. SHE KEPT ASKING, WHO CAN SHE TALK TO FOR THE FINES TO STOP AND THAT WE SHOULD BE WORKING TOGETHER AND NOT AGAINST. I EXPLAINED THE SM PROCEEDINGS TO HER ONCE AGAIN, AND SINCE THE ORDER HAS BEEN PUT DOWN AND AFTER THE ADDITIONAL TIME, COMPLIANCE WASN'T MET. I ADVISED HER IF SHE WAS STILL UNSURE TO PLEASE CONTACT MY SUPERVISOR MITCH POSNER.

ADVISED HER THE REASON THE RENTAL LICENSE WASN'T PASSED IS BECAUSE SO MANY UNRELATED PEOPLE WERE LIVING THERE MAKING IT A BOARDING HOUSE WHICH IS NOT LEGAL IN WPB. I ALSO REMINDED HER THAT OFFICER SAINT HILAIRE HAD TOLD HER THE SAME THING. ESTHER ADVISED THAT THE WOMAN RENTING THE PLACE HAD A STATE LICENSE TO BE OPERATING THERE BUT WAS NOT CLEAR ON WHAT THE LICENSE WAS FOR OR WHAT THE WOMAN WAS "RUNNING." SHE STATED SHE WOULD HAVE THIS RENTER CALL ME DIRECTLY. 10 MINUTES LATER I RECEIVED A CALL FROM SANDRA CAMERON, (561) 932-2988, WHO ADVISED SHE IS THE RENTER. I EXPLAINED WHAT I HAD BEEN TOLD ABOUT HER HAVING A "STATE LICENSE" AND SHE STATED SHE HAD NO STATE LICENSE AND SHE WAS SIMPLY RUNNING A "BOARDING HOUSE." I IMMEDIATELY INFORMED THAT THIS WAS NOT LEGAL IN WPB AS NO RENTAL CAN HAVE MORE THAN THREE UNRELATED PEOPLE. SHE STATED SHE WAS UNAWARE OF THIS BUT THAT SHE WAS NOT RUNNING A SOBER HOME OR AN ASSISTED LIVING FACILITY JUST A SIMPLE BOARDING HOUSE. SHE CLAIMED THAT SHE WAS ONLY AWARE OF NO MORE THAN 5 UNRELATED PEOPLE. I SUGGESTED SHE CALL ZONING FOR CLARIFICATION AND GAVE HER THAT NUMBER. SHE CALLED BACK A FEW MINUTES LATER TO ADVISE SHE HAD BEEN SWICTHED TO ANA APONTE AND LEFT HER A MESSAGE. SHE WAS THANKED AND ADVISED THE OPEN CASE WILL CONTINUE TO RUN FINES FOR THE OWNER AS LONG AS THE PLACE IS OCCUPIED DUE TO THE LICENSING VIOLATIONS. SHE STATED SHE WOULD SPEAK WITH THE OWNERS AND SEE HOW BEST TO PROCEED.

FRESH SOD WAS NOTED ON THE FRONT LAWN BUT THE SWALE NEEDS SOD AS IT WAS COVERED IN ROCKS. SEVERAL SCREENS ON THE FRONT OF THE HOUSE STILL NEED TO BE REPAIRED. THE PAVED PATH ON THE EAST SIDE OF THE HOUSE NEEDS TO BE REPAIRED. LARGE MIXED TRASH PILE IN THE ALLEY. SOME TRASH, DEBRIS, AND OUTDOOR STORAGE STILL IN THE REAR YARD STILL AND FENCE WORK STILL NEEDED. PICTURES ATTACHED TO CASE.

IN THE MIDDLE OF CONVERSATION IT BECAME OBVIOUS THAT SHE HAD THE CALL ON SPEAKER PHONE AND PROPERTY OWNER JOE KRAVICH WAS ON THE LINE AS WELL. MR. KRAVITZ STATED HE NEEDS THT EFINES TO STOP RUNNING AND THAT THE VIOLATIONS WERE COMPLIED. HE ALSO SAID IT WAS UNFAIR THAT HE NEVER RECIEVED NOTICE OF THE CASE AT ALL. AFTER LOOKING UP THE CASE PAPERWORK HE WAS ADVISED THAT NOTICE WAS SENT TO THE ADDRESS LISTED WITH THE COUNTY TAX OFFICE AT THE TIME AND POSTED TO THE PROPERTY. I REMINDED HIM HE ALREADY STATED HE FIRED THE PROPERTY MANAGER FOR MISHANDLING THIS CASE AT THE TIME AND THAT HIS TELLING US NOW THAT THE ADDRESS WITH THE COUNTY AT THE TIME (IT'S STILL THE SAME NOW) IS INCORRECT DOES CHANGE THE FACT THAT SERVICE WAS IN ACCORDANCE WITH THE LAW. I ALSO REMINDED HIM THAT OFFICER SAINT HILAIRE SPOKE WITH HIM SEVERAL TIMES BEFORE AND AFTER THE HEARING. HE FURTHER COMPLAINED THEY FIXED EVERYTHING AND I TOLD HIM ACCORDING TO THE PICTURES HE HAD NOT FIXED EVERYTHING YET AND STILL HASN'T PASSED RENTAL INSPECTION. HE STATED OFFICER SAINT HILAIRE REFUSES TO INSPECT THE PROPERTY AND I GAVE HIM THE DATES SHE DID INSPECT AND HE SAID HE NEEDED TO KNOW WHAT ELSE HAD TO BE FIXED AND I REMINDED HIM THAT HE HAD SHOWED UP AT CITY HALL AND HE AND I SPOKE IN PERSON GOING OVER THE EXISTING VIOLATIONS INCLDUING THE CURRENT CASE PICTURES FOR REFERENCE. HE STATED WPB MAKES IT TOO HARD FOR INVESTORS TO OWN PROPERTY HERE AND HE WAS GETTING A LAWYER TO FIGHT THIS CASE. I STATED IT WAS HIS RIGHT TO DO SO IF HE SO CHOOSES BUT WE WERE NOT GOING TO CONTINUE HIM ASKING THE SAME QUESTIONS AND GETTING THE SAME ANSWERS. ATTHIS POINT ESTHER SPOKE UP AND ASKED I FIND OUT WHY THEY FAILED THE RENTAL INSPECTION AND I ADVISED I'D CALL BACK THE NEXT DAY WITH AN ANSWER.

HE COMLAINED THAT OFFICER SAINT HILAIRE WOULD NOT COME INSPECT THE PROPERTY, THAT HE HAD ALREADY COMPLIED EVERYTHING AND SHE WOULD NOT STOP THE FINES RUNNING, AND THAT HE WAS NOT EVEN AWARE OF THE CASE WHEN IT WAS CITED. I WENT OVER THE CASE PICTURES WITH HIM AND DETAILED THE VIOLATIONS REMINDING HIM THAT HE ALSO HAS TO PASS A RENTAL INSPECTION TO COMPLY THE CASE. HE WAS ASSURED THAT HE WILL BE CONTACTED TO SCHEDULE AN INSPECTION. HE STATED HE HAD ALREADY FIRED HIS PROPERTY MANAGER OVER THIS ISSUE AND HE WAS TOLD THAT HIS PROPERTY MANAGER NOT INFORMING HIM OF THE NOTICE DOES NOT INVALIDATE THE NOTICE. HE COMPLAIEND THAT NO ONE WOULD GIVE HIM MORE TIME AND HE WAS ADVISED THAT THE CASE WAS ALREADY RULED ON BY A MAGISTRATE AND NO ONE IN CODE ENFORCEMENT HAS THE AUTHORITY TO EXTEND A MAGISTRATE'S ORDER.
