ON THE PREMISES.

2.) SAID ENCLOSURES SHALL BE
CONSTRUCTED OF WOOD SHADOWBOX FENCING IN
COMPLIANCE WITH THE ATTACHED
SPECIFICATIONS PROVIDED THAT THE
ESTIMATED COST AFTER THREE SEPARATE
QUOTES DOES NOT EXCEED $15,000.00. IF
THE ESTIMATED COST DOES EXCEED
$15,000.00, THE ENCLOSURES SHALL BE
CONSTRUCTED OF CHAIN LINK FENCING WITH
SUFFICIENT SLATS TO OBSTRUCT THE
CONTAINERS FROM PUBLIC VIEW.

3.) RESPONDENT SHALL OBTAIN THREE
SEPARATE QUOTES WITHIN FIFTEEN (15) DAYS
OF THE DATE OF THIS STIPULATION.

4.) RESPONDENT SHALL OBTAIN BUILDING
PERMITS FOR ALL WORK REQUIRED TO COMPLY
WITH THE TERMS OF THIS STIPULATION.
RESPONDENT SHALL HAVE FIFTEEN (15) DAYS
IN WHICH TO APPLY FOR THE NECESSARY
BUILDING PERMITS TO CONSTRUCT
ENCLOSURES. CITY AGREES TO ASSIST AND
EXPEDITE THE PERMIT APPROVAL PROCESS.

5.) UPON ISSUANCE OF BUILDING PERMIT BY
THE CITY, RESPONDENT SHALL HAVE FIFTEEN
(15) DAYS TO CONSTRUCT THE ENCLOSURES.

6.) CITY SHALL DELIVER TO RESPONDENT AN
EXECUTED AMENDMENT TO THE DECLARATION OF
UNITY WITHIN SEVEN (7) DAYS OF
COMPLETION OF ALL WORK REQUIRED BY
RESPONDENT TO COMPLY WITH THE TERMS OF
THIS STIPULATION.

7.) RESPONDENT SHALL MAINTAIN SAID
ENCLOSURES IN GOOD REPAIR SO THAT THE
ALL SOLID WASTE AND RECYCLING CONTAINERS
ARE OBSTRUCTED FROM PUBLIC VIEW.

8.) BOTH CITY AND RESPONDENT ACKNOWLEDGE
THAT COMPLIANCE WITH THE REMEDIAL
ACTIONS DETAILED HEREIN CONSTITUTE A
STIPULATED AGREEMENT IN CODE ENFORCEMENT
CASE NUMBER CE06090387 IN SETTLEMENT OF
THIS MATTER AND MAY NOT BE RELIED UPON
WITH RESPECT TO ANY OTHER PROPERTY OF
RESPONDENT OR AS PRECEDENT IN ANY OTHER
MATTER.

9.) IN THE EVENT THE RESPONDENT?S
PROPERTY LOSES ITS NON-CONFORMING USE
STATUS, RESPONDENT SHALL BE REQUIRED TO
COMPLY WITH THE THEN CURRENT
SPECIFICATIONS REGARDING SOLID WASTE
CONTAINERS AND ENCLOSURES.
