  MS. GRETA MINTER CALLED REGARDING THE RAILROAD CROSSING @ 7
  STREET & 15TH. SHE SAID THE TRACKS ARE SO TORN UP YOU HAVE
  TO DRIVE AROUND THE DAMAGED AREAS. SHE SAID IT'LL TEAR
  YOUR CAR UP. THIS IS A LIABILITY FOR THE CITY OR WHOEVER
  OWNS THIS, AND IS DANGEROUS.
  SHE CONTACTED CSX AND THEY WROTE HER A LETTER (WHICH SHE
  FAXED OVER TO ME). IT CLEARLY SAYS THIS IS NOT THEIR
  RESPONSIBILITY, AND THE CITY OF WEST PALM BEACH IS
  RESPONSIBLE FOR THE MAINTENANCE.
  PLEASE CALL MS. GRETA MINTER & ADVISE. 561-833-9814. I
  WILL KEEP THE LETTER TEMPORARILY IF YOU NEED IT.

  WELL I HAD RECALLED THAT YOU MENTIONED THAT THE TIES WERE
  ROTTED IN A NUMBER OF PLACES AND THAT THE RUBBER WAS COMING
  UP COMPLETELY ON ANOTHER. TO ME THIS SOUNDED LIKE THE
  CROSSINGS NEED TO BE REBUILT. SIMPLE POTHOLE PAVING IS NOT
  REALLY GOING TO FIX THESE ISSUES. ULTIMATELY THE
  ROADMASTER WOULD KNOW BEST WHAT IS NEEDED TO MAKE THESE
  LOCATIONS SAFE. IF ALL WE NEED IS THE PAVING WORK, THEN A
  LETTER AGREEMENT CAN BE SENT FOR REIMBURSEMENT TERMS. I
  HAVE CLEARED THIS WITH THE APPROPRIATE PEOPLE. SO, NOW, WE
  JUST NEED ROADMASTER MAGARGLE TO MAKE THE CALL ON REBUILD
  VS SPOT FIXES.

  WHEN I STARTED TO RESEARCH THE 7TH STREET AGREEMENT, I CAME
  ACROSS THE FOLLOWING (PLEASE SEE ATTACHED AGREEMENTS FOR
  PROOF- I???VE HIGHLIGHTED THE PERTINENT PARAGRAPHS):
   
  - 7TH STREET WAS OPENED UNDER AGREEMENT SAL55143
  ALONG WITH TWO OTHER CROSSINGS IN 1959
  - A SUPPLEMENT TO THIS AGREEMENT, SAL55143, WAS
  SIGNED IN 1964 STATING THAT SINCE 23RD STREET CROSSING WAS
  NEVER OPENED, THEY WANTED TO OPEN TO 25TH STREET INSTEAD
  UNDER THE SAME AGREEMENT.
  - I ALSO SAW IN OUR ARCHIVED FILES THAT THE PHASE
  A AGREEMENT REFERENCES THIS AGREEMENT SAL55143 WITH THE
  CITY IN EXHIBIT 5.
  - I READ THE PARTS THAT REFERENCE EXHIBIT 5 AND
  FOUND THAT CSX IS AUTHORIZED TO ADMINISTER THE TERMS OF THE
  EXISTING AGREEMENTS ON BEHALF OF THE STATE. THIS MEANS
  THAT THE MAINTENANCE TERMS OF THE ORIGINAL AGREEMENT, WHICH
  PLACES SOLE RESPONSIBILITY ON THE CITY, WILL BE OVERSEEN BY
  CSX IN THE NAME OF THE STATE.
  - THE 1995 AGREEMENT WHICH WE WERE AWARE OF
  PREVIOUS STATES THAT AFTER THE RUBBER CROSSING WAS
  INSTALLED, CSX IS RESPONSIBLE FOR MAINTENANCE IN ACCORDANCE
  WITH THE PHASE A AGREEMENT. THIS NEW FINDING SAYS THAT THE
  PHASE A AGREEMENT ALLOWS CSX TO BE REIMBURSED BY THE CITY
  FOR THE MAINTENANCE UNDER THE ORIGINAL AGREEMENT REFERENCED
  IN EXHIBIT 5.
   
  ALL THE AGREEMENTS ARE ATTACHED. IF ANYONE CAN FIND
  SOMETHING TO THE CONTRARY OR CAN EXPLAIN A DIFFERENT
  INTERPRETATION, I HAVE NO OBJECTION TO LOOKING INTO IT.
  BUT NOW, IN LIGHT OF MY NEW UNDERSTANDING, THE REBUILDING
  OF ALL THREE CROSSINGS, 7TH ST 15TH ST AND 25TH ST, WILL
  FINANCIALLY FALL ON THE CITY. I AM COPYING MR. DAVE KRAFFT
  WITH HDR, OUR CONSULTANT IN THE FLORIDA AREA, SO THAT HE IS
  AWARE OF THE SITUATION. IF THESE CROSSINGS ARE TO BE
  REBUILT, I WILL HAVE HDR PUT TOGETHER ESTIMATES AND SEND
  THE CITY CONSTRUCTION/REIMBURSEMENT AGREEMENTS FOR THE
  WORK. LET ME KNOW HOW YOU???D LIKE ME TO PROCEED. THANKS.

  THE STATE AGREED TO COVER EXPENSES FOR REPAIRS BETWEEN THE
  TIES AT 25TH STREET (AS ESTABLISHED BY THE AGREEMENT) UNDER
  THE MAINTENANCE OP# FOR THE FDOT/CSX SOUTH FLORIDA RAIL
  CORRIDOR. THE CITY WILL HAVE TO OBTAIN AN OP# FROM CSX TO
  CHARGE EXPENSES FOR WHICH THE CITY IS RESPONSIBLE, SUCH AS
  ASPHALT. I BELIEVE THE CITY MAY USE THEIR OWN ASPHALT
  CONTRACTOR.
   
  15TH STREET THE AGREEMENT FROM THE 1950S ESTABLISHES THE
  CITY AS RESPONSIBLE 100%
   
  7TH STREET, I DO NOT HAVE A COPY OF THE AGREEMENT, MARY DO
  YOU HAVE A COPY OF THE AGREEMENT FOR THIS LOCATION?
   
  FDOT HAS PROVIDED ITS CONSENT FOR CSX TO COMPLETE THIS WORK
  AND BUDGETED FOR THIS EXPENSE AS WELL.
