| | | THAT THE MAINTENANCE TERMS OF THE ORIGINAL AGREEMENT, WHICH |
| | | PLACES SOLE RESPONSIBILITY ON THE CITY, WILL BE OVERSEEN BY |
| | | CSX IN THE NAME OF THE STATE. |
| | | - THE 1995 AGREEMENT WHICH WE WERE AWARE OF |
| | | PREVIOUS STATES THAT AFTER THE RUBBER CROSSING WAS |
| | | INSTALLED, CSX IS RESPONSIBLE FOR MAINTENANCE IN ACCORDANCE |
| | | WITH THE PHASE A AGREEMENT. THIS NEW FINDING SAYS THAT THE |
| | | PHASE A AGREEMENT ALLOWS CSX TO BE REIMBURSED BY THE CITY |
| | | FOR THE MAINTENANCE UNDER THE ORIGINAL AGREEMENT REFERENCED |
